introduction

welcome to snackr. these terms of service ("terms") govern your use of the snackr mobile application ("app"). by downloading, installing, or using snackr, you agree to these terms.

snackr is developed and operated by Alexander Jandl ("we," "us," or "our"), an individual developer established in Slovakia, European Union, through the Apple Developer Program and Google Play Console.

if you do not agree to these terms, please do not use snackr.

1. acceptance of terms

by using snackr, you acknowledge that you have read, understood, and agree to be bound by:

our privacy policy
Apple's App Store terms and conditions (iOS)
Google Play Store terms of service (Android)

2. eligibility

snackr is rated for ages 4 and up. if you are under 18, you should review these terms with a parent or guardian.

3. description of service

snackr is a restaurant discovery app that:

recommends nearby restaurants based on your location
allows you to swipe through cuisine types to express preferences
provides personalized restaurant suggestions
offers optional premium features through snackr+ subscription

free version

the free version of snackr includes:

basic restaurant recommendations
cuisine preference selection
limited swipes per month

snackr+ subscription

snackr+ is an optional paid subscription that includes:

unlimited swipes
enhanced restaurant data
dietary preference filters (optional to set)
price range preferences
group mode for dining with friends
priority support

pricing:

monthly: $4.99/month (or equivalent in your local currency)
annual: $39.99/year (or equivalent in your local currency)

subscriptions are processed through Apple's App Store (iOS) or Google Play Store (Android) and are subject to their respective payment terms.

4. user accounts

anonymous by default

you do not need to create an account to use snackr. we generate an anonymous user ID (UUID) to enable app functionality. this ID is not linked to your personal identity and remains associated with your device.

5. location services

snackr requires access to your device location to function. by granting location permission, you:

consent to collection of your current location coordinates
understand that location data is used to find nearby restaurants
acknowledge that location data may be shared with third-party data providers

you can revoke location access through your device settings, but the app will not function without it.

6. subscription terms

6.1 payment

all subscriptions are processed through Apple App Store (iOS) or Google Play Store (Android)
payment is charged to your Apple ID account (iOS) or Google Play account (Android)
prices are shown in your local currency in the respective app store
we do not have access to your payment information

6.2 free trial

new subscribers may receive a free trial period (if offered). you can cancel anytime during the trial without charge. if you don't cancel before the trial ends, you will be charged the subscription fee.

6.3 automatic renewal

subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period. you will be charged for renewal within 24 hours before the current period ends.

6.4 cancellation

you can cancel your subscription at any time through:

App Store app → Account → Subscriptions → snackr

cancellation takes effect at the end of your current billing period. you will retain access to snackr+ features until then.

6.5 refunds

refund requests are handled by Apple or Google according to their respective policies. we do not control or process refunds.

6.6 price changes

we may change subscription prices at any time. price changes will apply to new subscriptions and renewals after notice is provided. existing subscribers will be notified at least 30 days before a price increase.

7. acceptable use

you agree to use snackr only for lawful purposes. you agree not to:

violate any applicable laws or regulations
use the app in a way that could harm, disable, or impair the service
attempt to gain unauthorized access to our systems
reverse engineer, decompile, or disassemble the app
use automated systems (bots, scripts) to access the service
collect or harvest data from the app
impersonate others or provide false information
use the app for commercial purposes without permission
abuse group mode features (spam, harassment, etc.)

violation of these terms may result in suspension or termination of your access.

8. intellectual property

8.1 our rights

snackr, including all content, features, and functionality, is owned by Alexander Jandl and protected by copyright, trademark, and other intellectual property laws.

you are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.

8.2 third-party content

restaurant information, photos, ratings, and reviews are provided by third-party data providers and are owned by their respective owners. we do not claim ownership of this content.

8.3 trademarks

"snackr" and the snackr logo are trademarks of Alexander Jandl. you may not use these marks without permission.

9. user-generated content

group mode nicknames

when using group mode, you can set a nickname. by providing a nickname, you agree that:

the nickname does not violate others' rights
the nickname is not offensive, abusive, or inappropriate
we may remove or modify nicknames that violate these terms

nicknames are ephemeral and deleted when the group session ends.

10. disclaimers and limitations

10.1 restaurant information

restaurant information (names, ratings, addresses, hours, menus) is provided by third-party data providers. we do not guarantee:

accuracy of restaurant information
availability of restaurants
quality of food or service
that restaurants are currently open or operating

always verify information directly with the restaurant before visiting.

10.2 recommendations

snackr provides restaurant recommendations based on your preferences and location. recommendations are algorithmic and subjective. we do not guarantee:

that you will enjoy recommended restaurants
that recommendations match your exact preferences
availability of specific dishes or menu items

10.3 "as is" service

snackr is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

merchantability
fitness for a particular purpose
non-infringement
uninterrupted or error-free service

10.4 limitation of liability

to the maximum extent permitted by law, Alexander Jandl shall not be liable for:

indirect, incidental, special, consequential, or punitive damages
loss of profits, revenue, data, or use
food poisoning, allergic reactions, or health issues from restaurants
personal injury or property damage
any damages exceeding the amount you paid for snackr+ in the past 12 months

EU consumer rights: nothing in these terms limits your statutory rights as a consumer under EU law.

11. health and dietary information

11.1 dietary preferences disclaimer

if you use dietary preference features (vegetarian, vegan, allergen filters), please note:

these filters rely on third-party data that may be incomplete or inaccurate
we cannot guarantee that restaurants accommodate your dietary needs
always verify with the restaurant if you have allergies or strict dietary requirements
we are not liable for allergic reactions, food sensitivities, or health issues

11.2 health conditions

if you have food allergies, celiac disease, or other health conditions:

do not rely solely on snackr for dietary safety
always inform restaurant staff of your dietary restrictions
verify ingredients directly with the restaurant

12. third-party services

snackr integrates with third-party services:

restaurant data providers

we use third-party services to retrieve restaurant information. these services have their own terms of service and privacy policies that govern their use.

app stores

subscriptions are processed through Apple (iOS) or Google (Android). your use is subject to:

we are not responsible for third-party services or their content.

13. termination

13.1 your right to terminate

you can stop using snackr at any time by:

deleting the app from your device
canceling your subscription (if applicable)

13.2 our right to terminate

we may suspend or terminate your access if you:

violate these terms
engage in fraudulent or illegal activity
abuse the service or other users

we will provide notice before termination unless immediate action is required for legal or security reasons.

13.3 effect of termination

upon termination:

your license to use snackr ends immediately
your data may be deleted after a reasonable period
subscription fees are non-refundable (subject to Apple's refund policy)

14. changes to terms

we may update these terms from time to time. we will notify you of material changes by:

updating the "last updated" date
displaying a notice in the app
for significant changes: requiring acceptance before continued use

your continued use after changes constitutes acceptance of the new terms.

15. governing law and dispute resolution

15.1 governing law

these terms are governed by the laws of the European Union and the laws of Slovakia.

15.2 dispute resolution

if you have a complaint or dispute:

contact us first: email us at support@snackr.food to resolve the issue
mediation: if we cannot resolve the dispute, we both agree to attempt mediation
legal action: EU consumers may bring legal action in their country of residence

15.3 EU consumer rights

if you are a consumer in the EU, nothing in these terms affects your statutory rights under EU consumer protection law, including:

right to cancel within 14 days (note: this right is waived when you start using subscription features)
right to conformity
right to remedy for defective products

16. severability

if any provision of these terms is found to be unenforceable, the remaining provisions will remain in full effect.

17. entire agreement

these terms, together with our privacy policy, constitute the entire agreement between you and Alexander Jandl regarding snackr.

appendix: EU consumer rights summary

as a consumer in the European Union, you have specific rights:

right of withdrawal (14 days)

you have the right to cancel your subscription within 14 days without giving a reason. however, if you request immediate access to snackr+ features, you waive this right for that billing period.

right to conformity

the app should conform to the description provided in the App Store.

remedies for defects

if the app is defective, you may be entitled to:

repair or replacement
price reduction
refund

how to exercise your rights

or contact your local consumer protection authority.
